The Meijers Committee published on 10 October 2012 a note on the amended proposal for a Regulation on the establishment of Eurodac. The new draft provides for the possibility to request comparison with Eurodac data by Member States law enforcement authorities and Europol. This was also proposed in 2009 but lapsed as a consequence of the Treaty of Lisbon.

A German coalition composed of seven organisations (Pro Asyl, Diakonie, the Paritärische Welfare Association, AWO, the Jesuit Refugee Service, the German Bar Association and the Neue Richtervereinigung) has issued a memorandum criticising the Dublin system for the allocation of responsibility for the examination of asylum claims in the EU. The memorandum argues that the current system overburdens states at the external borders at the EU and, as a result of this, forces asylum seekers into destitution and loss of their rights.

Last December, the Hungarian Supreme Court issued its opinion on the concept of "safe third country". This opinion is of relevance as it shall guide the application of this concept by Hungarian judges and thus promote a harmonised practice in asylum cases. The reason for issuing this opinion was precisely the divergence in the criteria applied by Hungarian courts when reviewing administrative decisions.

The reference pertains to the interpretation of Article 15(c) of Directive 2004/83/EC and the clarification of the definition of "internal armed conflict". The Court essentially asks whether the definition of armed conflict under Article 15(c) should be linked to international humanitarian law or whether it should be interpreted autonomously. In the latter case, the Conseil d'Etat also asks what should be the criteria for such an autonomous interpretation.
