New CJEU reference: Case C-473/13, Adala Bero v Regierungspräsidium Kassel

A reference for a preliminary ruling concerning Article 16(1) of Directive 2008/115/EC was published by the CJEU on 25 October 2013. It was lodged on 3 September by the Bundesgerichtshof (Germany) and the question reads as follows:

Does Article 16(1) of Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008 on common standards and procedures in Member States for returning illegally staying third-country nationals  also require a Member State to carry out detentions for the purpose of removal as a rule in specialised detention facilities when such facilities exist in only one part of the federal subdivisions of that Member State but not in others?  Read the reference on the website of the CJEU.
