The interveners’ submissions focus on a) how criminalization of consensual same sex conduct gives rise to a real risk of Article 3 ECHR prohibited treatment, b) how enforced concealment of one’s sexual orientation constitutes persecution under refugee law and is incompatible with the ECHR, and c) the risk of persecution based on same-sex sexual orientation in The Gambia.
